Agri SA cautions ad hoc committee on amending Section 25 of the Constitution

 

On 6 November 2019, Agri SA attended a constitutional dialogue on land ownership hosted by the ad hoc committee in parliament tasked with initiating legislation to amend the property clause. Agri SA and several other organisations and experts were invited. Annelize Crosby, head of Agri SA’s centre of excellence on land and SK Makinana, board member of Agri SA, attended the session.

A detailed agenda was not provided and there were lengthy debates on the purpose of the meeting. Whilst some members of Parliament held the view that the committee had a clear mandate to focus only on the amendment of Section 25, Agri SA maintained that it’s only mandate
was to reject any amendment to section 25.

Agri SA shared the following views on any proposed amendment to section 25 of the Constitution with the committee:
Section 25 is not an impediment to land reform – amending the property clause will not result in sustainable land reform.
Land reform failure stems from implementation failures, corruption, lack of political will, and inadequate funding.
An amendment to Section 25 may hold serious economic consequences for the country. Crosby appealed to the committee to take proper cognisance of the potential catastrophic economic consequences of an amendment.

The Ad Hoc committee agreed to receive written submissions from participants. Agri SA has provided a submission, as did Dan Kriek, in his capacity as a member of the Advisory Panel on Land Reform and Agriculture. In his submission, Kriek criticises the Advisory Panel’s recommendation that section 25 should be amended and points out flawed legal thinking in this regard. Kriek maintains that the panel proposal was politically inspired. Agri SA is of the view that the expropriation of land without compensation is not acceptable in a democratic society based on human dignity, equality and the protection of fundamental rights.

“One can safely state that the caveats set by the ANC policy conference, cannot hold true anymore,” said Kriek. “The ANC Government can no longer claim these caveats to be true and applicable.”

Kriek also highlighted red lights in the South African economy which should form part of the context of this debate. “We may see high levels of divestment in the economy, food inflation and regional food insecurity if we water down property rights” Kriek said.

Agri SA created a Land and Environmental Fund to protect the rights of all South Africans in matters relating to expropriation without compensation.

“We call on all South Africans that want progress and inclusive economic growth to support us” Kriek said.

Agri SA will continue to protect the rights of its members and will not hesitate to exercise available legal options to protect the Constitutional right of all South Africans to property.

Agri SA waarsku ad-hoc komitee oor wysiging van artikel 25 van die Grondwet

Op 6 November 2019, het Agri SA ‘n grondwetlike dialoog oor grondbesit, wat gereël is deur die Ad-hoc Komitee in die Parlement, wat getaak is met die inisiëring van wetgewing ter wysiging van die eiendomsklousule, bygewoon. Agri SA en verskeie ander organisasies en kundiges is genooi om daaraan deel te neem. Annelize Crosby, Agri SA se hoof van die Sentrum van Uitnemendheid oor grond en SK Makinana, ‘n direksie lid van Agri SA, het die geleentheid bygewoon.

‘n Gedetailleerde sakelys was nie beskikbaar nie en daar was verwarring oor die doel van die vergadering. Terwyl sommige parlementslede van mening was dat die komitee ‘n duidelike mandaat het om slegs op die wysiging van artikel 25 te fokus, het Agri SA volgehou dat sy enigste mandaat is om enige sodanige wysiging van artikel 25 te verwerp.

Agri SA het die volgende standpunte oor enige voorgestelde wysiging van artikel 25 van die Grondwet met die komitee gedeel:
˗ Artikel 25 is nie ‘n struikelblok in die weg van grondhervorming nie en die wysiging van die eiendomsklousule sal nie volhoubare grondhervorming tot gevolg hê nie.
˗ Die mislukking van grondhervorming het te make met mislukte implementering, korrupsie, ‘n gebrek aan politieke wil en onvoldoende befondsing.
˗ Wysiging van artikel 25 kan ernstige ekonomiese implikasies vir die land inhou. Crosby het ‘n beroep op die komitee gedoen om behoorlik van die moontlike katastrofiese ekonomiese gevolge van sodanige wysiging kennis te neem.

Die ad-hoc komitee het ingestem om skriftelike voorleggings van deelnemers te aanvaar. Agri SA het die komitee van ‘n voorlegging voorsien, so ook Dan Kriek in sy hoedanigheid as lid van die Adviespaneel vir Grondhervorming en Landbou. In sy voorlegging kritiseer Kriek die Paneel se aanbeveling dat artikel 25 gewysig moet word en wys op foutiewe regsargumente in hierdie verband. Hy meld dat die Paneel se voorstel polities van aard is. Agri SA is van mening dat onteiening van grond sonder vergoeding nie in ‘n demokratiese samelewing, wat gegrond is op menswaardigheid, gelykheid en die beskerming van fundamentele regte, aanvaarbaar is nie.

“Daar kan met sekerheid gesê word dat die voorbehoude wat tydens die ANC-beleidskonferensie geopper is nie meer as geloofwaardig beskou kan word nie,” sê Kriek. “Die ANC-regering kan nie meer beweer dat hierdie voorbehoude geldig en van toepassing is nie.”
Kriek het ook verwys na flikkerligte in die Suid-Afrikaanse ekonomie wat behoort deel te vorm van die konteks van hierdie debat.

“Ons kan moontlik hoë vlakke van disinvestering in die ekonomie, voedsel-inflasie en streeksvoedselonsekerheid ervaar indien ons eiendomsregte afwater,” aldus Kriek.

Agri SA het ‘n Grond- en Omgewingsfonds geskep om die regte van alle Suid-Afrikaners in onteiening sonder vergoeding-verwante aangeleenthede te beskerm.

“Ons doen ‘n beroep op alle Suid-Afrikaners wat vooruitgang en inklusiewe ekonomiese groei nastreef om ons te ondersteun,” vra Kriek.

Agri SA sal voorgaan om die regte van sy lede te beskerm, en sal nie skroom om beskikbare wetlike opsies te gebruik om die Grondwetlike eiendomsreg van alle Suid Afrikaners te beskerm nie.
